PAAFE hase completed one court case on access to information

BAKU, 12 Feb 10 -- Court of Appellate considered refusal of Ministry of Education on reply to information survey lawlessly and put duty on ministry to answer information survey.

On February 10, 2010 appeal complaint of Zohrab Ismayilov on lawlessly answer of the Ministry of Education to information survey of PAAFE was looked at the Court of Appellate with chairmanship of the judge Aygun Abdullayeva. Appeal complaint was provided with decision of law-court board, was changed with decision of Nerimanov region court dated on March 10, 2009. Law-court board considers that refusal of the Ministry of Education to answer information survey is lawless and ministry must answer the survey.

Mention that PAAFE has sent information survey to the Ministry of Education on January 26, 2009 to get information about construction of school buildings and construction-estimate expenses. During implementation of project “Monitoring of investments allocated from state budget for construction and repair of schools” there appeared need for this information. Ministry of Education replied with their letter dated on February 24, 2009 that information asked in survey can be answered after they will be based on legislation. Applicant complained to Nerimanov region court, court justified Ministry of Education. Decision of Nerimanov region court has been kept in force with decision of Baku Court of Appellate dated on July 28, 2009. Decision of Appellate Court was liquidated with decision of the Supreme Court dated on November 23, 2009 and had been sent to Baku Appellate Court for renew.
